PETITION

To: The Honorable Judge Robert Guterl, Superior Court of New Jersey

Sir:

At the Extraordinary General Membership Meeting of the St. Mary's Protectress UOC in Philadelphia, PA, held on October 3, 1999 the Parish Council was authorized to petition the Superior Court of New Jersey to remove the name of St. Mary's Protectress UOC of Philadelphia from the list of plaintiffs in the Civil Action of Ukrainian Orthodox Church of the USA., Archbishop Antony, et al vs John Luchejko, et al.

We are making this request for the following reasons:

  1. We, as members of the UOC of USA, were never informed nor consulted about Archbishop Antony's plans, or their appropriateness, to initiate a civil action against a sister parish.
  2. This civil action contradicts the articles of the Constitution of the UOC of USA, specifically the section dealing with conflict resolution.
  3. This civil action violates Canon 9 of the Fourth Ecumenical Council, which instructs conflicting parties not to turn to "civil judges" to resolve their conflicts.

For these reasons, we do not agree with the civil action initiated by Archbishop Antony and request that our name be removed from the list of plaintiffs.

Signed… John Prasko, President and Olha Hursky, Secretary
