On September 29, 1999 St. Peter and Paul Parish officially notified Mr.Myroslaw Smorodsky, attorney for Holy Ascension, Clifton, NJ, through their attorney Mr. Richard Daniels that:
"The Parish Board members wish to have it understood that St. Peter
and Paul Ukrainian Orthodox Church is not interested in being a plaintiff in
regard to the [UOC-USA vs. UOC-Holy Ascension lawsuit]. They feel, as does your
client, that this matter should be handled through church councils and not through
the court".
Further: "At a minimum, St. Peter and Paul Ukrainian Orthodox Church
would like to make a motion to be removed as one of the supposed plaintiffs in
this matter. Secondly, it may well be that St. Peter and Paul Ukrainian
Orthodox Church would join the litigation on the side of your clients [Holy
Ascension, Clifton, NJ]".
